OVERVIEW

Welcome to Party-verse. The terms “we,” “us,” and “our” refer to Party-verse, operated by Y-AMS. Party-verse operates this online store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”).

Party-verse is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced on our website, describe your rights and responsibilities when using the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms, you should not access or use the Services.

By using the Services, you confirm that you are at least the age of majority in your state, province, or country of residence, or that you have permission from a parent or legal guardian.

You may be required to provide information such as your email address, billing information, payment information, and shipping address. You agree that all information you provide is accurate, current, and complete.

We make reasonable efforts to display and describe our products accurately. However, product colors and appearance may vary depending on your device, screen settings, lighting, and other factors.

Product measurements may vary slightly because of manual measurement. Please review all product images, descriptions, available options, and size information before ordering.

We reserve the right to change product descriptions, prices, availability, and other information without prior notice. We may discontinue products or limit the quantity available to any person, household, geographic region, or jurisdiction.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase. Party-verse reserves the right to accept, reject, limit, or cancel an order when reasonably necessary.

Your order is accepted after payment has been successfully processed and we send an order confirmation.

Please review your order details, selected variants, and shipping address carefully before completing your purchase. We might not be able to change or cancel an order after it has entered processing or fulfilment.

If we reject, change, or cancel an order, we will attempt to contact you using the email address, telephone number, or billing information supplied with the order.

Returns, exchanges, and refunds are governed by our Return and Refund Policy, which is available through our website.

Products purchased through our store are intended for personal or household use and not for unauthorized commercial resale.

SECTION 4 – PRICES AND PAYMENTS

All prices, discounts, and promotions are subject to change without prior notice.

The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors. Applicable taxes, shipping charges, customs duties, or import charges may be displayed separately during checkout.

You agree to provide current, complete, and accurate billing and payment information.

You represent that you are legally authorized to use the payment method provided and that the payment information is accurate.

We may use third-party payment providers to process payments. Your use of those services may also be subject to the terms and privacy policies of the relevant payment provider.

SECTION 5 – SHIPPING AND DELIVERY

Shipping locations, estimated delivery times, and applicable shipping charges are described in our Shipping Policy.

Delivery dates are estimates and are not guaranteed. Delays may occur because of carriers, customs processing, weather, high seasonal demand, incorrect delivery information, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Party-verse is not responsible for delays or failed delivery caused by incorrect or incomplete information supplied by the customer.

Ownership and risk relating to shipped products will transfer as required by applicable law.

SECTION 6 – RETURNS AND REFUNDS

Return requests must comply with our Return and Refund Policy.

Customers must contact us and receive return instructions before sending an item back. Items returned without prior approval may not be accepted.

Refunds are issued to the original payment method after the returned item has been received, inspected, and approved.

SECTION 7 – INTELLECTUAL PROPERTY

The Services, including our store name, logo, design, written content, graphics, photographs, videos, product presentation, and other materials, are owned by Party-verse, Y-AMS, Shopify, or their respective licensors and are protected by applicable intellectual-property laws.

You may access and use the Services for personal, non-commercial purposes only.

You may not copy, reproduce, distribute, modify, republish, sell, license, publicly display, or commercially exploit any part of the Services without prior written permission from the relevant rights holder.

Shopify’s name, logo, product names, and other marks are trademarks belonging to Shopify or its affiliates.

SECTION 8 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment services, shipping services, or other features operated by third parties.

These third-party services are provided subject to their own terms and policies. We do not control and are not responsible for third-party services, except where responsibility cannot legally be excluded.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Party-verse is powered by Shopify, which provides the ecommerce platform used to operate the store.

Purchases made through our store are transactions directly between you and Party-verse. Shopify is not the seller of the products offered by Party-verse and is not responsible for fulfilment, delivery, returns, refunds, product quality, or customer-service matters relating to those purchases.

SECTION 11 – PRIVACY

Personal information collected through the Services is processed according to our Privacy Policy, available through our website.

Because our store is hosted by Shopify, Shopify processes certain personal information to provide and improve its services.

Information may also be processed by payment providers, shipping providers, analytics services, advertising services, suppliers, and other service providers when necessary to operate the store and fulfil orders.

SECTION 12 – CUSTOMER FEEDBACK AND REVIEWS

If an order is cancelled after payment because of an error, the applicable payment will be refunded.

To the fullest extent permitted by applicable law, Party-verse, Y-AMS, Shopify, and their respective affiliates, employees, agents, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Services or products purchased through the Services.

This includes, where legally permitted, loss of profits, revenue, data, savings, opportunity, or replacement costs.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for fraud, intentional misconduct, or other liability that cannot legally be excluded.

SECTION 18 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Party-verse, Y-AMS, Shopify, and their respective affiliates, employees, agents, contractors, licensors, and service providers harmless from third-party claims resulting from:

• Your material breach of these Terms
• Your unlawful use of the Services
• Your violation of another person’s legal rights

This provision does not apply where responsibility rests with Party-verse or where indemnification is prohibited by applicable law.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or removed where necessary.

The remaining provisions will continue to be valid and enforceable.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with our posted policies and applicable order information, constitute the agreement between you and Party-verse regarding your use of the Services.

If any ambiguity arises, it will be interpreted according to applicable law and not automatically against either party.

SECTION 21 – ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights and obligations in connection with a business restructuring, sale, merger, or transfer of the store, subject to applicable law and privacy requirements.

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of the Netherlands.

Disputes will be submitted to the competent courts of the Netherlands, unless mandatory consumer-protection law grants the customer the right to bring a claim in another jurisdiction.

Nothing in this section removes any mandatory rights available to consumers under applicable law.
